Artificial Intelligence and its Legal Challenges in the Field of Information Technology

(An Analytical Study within the Framework of International Law)

Abstract

This analytical study addresses the legal challenges posed by the use of artificial intelligence (AI) in the field of information technology within the framework of international law. With the rapid advancement of digital technologies and the increasing reliance on AI in various domains such as data analysis, network management, and autonomous decision-making, significant challenges emerge for traditional legal frameworks that were not designed to keep pace with these modern innovations. The study highlights the main legal issues facing the international community, including the protection of privacy and personal data, ensuring cybersecurity, and determining legal liability in the event of damages caused by AI systems, in addition to challenges related to intellectual property rights and innovation protection. The study also examines the impact of the absence of comprehensive and binding international legislation on the ability of states and institutions to regulate AI usage effectively, which may lead to legal discrepancies between countries and increased risks. The study aims to analyze these legal gaps in international law and provide proposed legal solutions that ensure the protection of digital rights, balance technological innovation with legal responsibility, and review ongoing international efforts, such as United Nations principles and regional initiatives, in regulating AI. The study adopts a critical analytical approach that allows for a deeper understanding of the legal challenges associated with AI and establishes a reference legal framework that can guide the development of future international legislation aligned with continuous technological progress.
