Security Council Intervention in the Demarcation of the Iraqi – Kuwaiti Maritime Borders
Abstract
It is recognized in the light of the principles of general international law that the process of demarcation of international borders, including international maritime boundaries, is subject to the will, consent and free will of the States in their respective interests and on the understanding that the process of mutual confidence Consensus and mutual conviction and good neighborliness, is a factor of stability and cooperation and sustainability in the relations between them. The importance of the study was the result of the establishment of the Mubarak port of Kuwait in a narrow navigational corridor that cannot accommodate two vessels at the same time, following the demarcation of the border in implementation of the UN Security Council resolution 833, which will make Iraq a closed country without a sea port.
The study of the demarcation of the maritime border between Iraq and Kuwait and the resulting conflict, followed by the Security Council, and the adoption of the demarcation of the maritime borders of the two countries in a precedent of their kind, violates the customary rules and the international agreement.
The study followed the analytical descriptive method to show the steps taken in addressing the border dispute and analyzing the decisions and procedures that resultedو the study reached the following results:
- The Security Council's border demarcation committee is based on old maps dating back to 1932, drawn up by monopolistic oil companies in the era of colonial domination, which are stagnant.
- The Security Council disregarded the right of participation guaranteed by the 1982 UN Convention on the Law of the Sea, depriving Iraq of this right.
The study recommended several recommendations, the most important of which are:
- Accelerate the construction of the port of FAO and allocate the necessary funds in the state budget for the coming years, or open the door for international investments and facilitate the means of work and investment in the establishment of Iraq Faw port.
- Taking all legal and political means and resorting to the United Nations and international organizations to demonstrate the extent to which the Kuwaiti Mubarak port harms Iraq's interests.
