Inheritance and Homosexuality between Sharia and the Law

Abstract

Homosexuality is one of the forms of sexual perversion that was forbidden by the street in several Qur’anic verses. The Qur’anic trend became a constitution to prohibit these acts in statutory laws. The matter began to expand with the documentation and approval of homosexuality in many countries of the world, especially the developed ones in Europe and America, and laws were regulated for it. Anyone who touches homosexual persons is punished, and what is meant by the marriage of a male to a male or a female to a female is punished. This matter violates Islamic law, which sanctifies the marital relationship between a male and a female and regulates its provisions, especially the financial ones. The wife inherits the husband and the husband inherits the wife. A share in the inheritance was determined for each of them. It was specified that the wife gets one-eighth with the inheriting descendant, and she gets one-fourth with no inheriting descendants, and the husband gets one-fourth with no descendants, and he gets half in the event that there are no descendants to her. There is similarity in inheritance for some categories permitted by Sharia and the law. The law has not regulated some issues to confront them. The phenomenon of homosexuality is supposed to begin with the legislation of laws such as private international law and inheritance law, and the emphasis on homosexuals and the enactment of laws regulating the ownership of financial matters to them.
